Terms of Service

Effective Date: 1 February 2026

1. About Us

Scale and Sustain is a trading name of Marie Guyot, sole trader, operating in England (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of our website and any products or services provided by Scale and Sustain.

2. Scope of These Terms

These Terms apply to all services and products offered through our website or directly by us, including but not limited to:
- Online courses and digital content
- Group programmes
- One-to-one mentoring
- Strategic advisory services
- Workshops, events, or masterclasses

By accessing our website or purchasing any service, you agree to be bound by these Terms.

3. Nature of Services

Our services are educational and mentoring in nature. They are designed to provide business frameworks, strategic guidance, and founder development support.

Our services do not constitute financial, investment, legal, tax, or accounting advice. You remain solely responsible for all business decisions and implementation.

4. No Guarantee of Results

We make no guarantees regarding revenue, profitability, funding, exit outcomes, or business growth. All results depend on your execution, market conditions, and external factors beyond our control.

Any examples, testimonials, or case studies are illustrative only and do not constitute guarantees.

5. Payment Terms

Payment terms are set out at the point of purchase, including any invoice, agreement, or payment link provided.

Unless otherwise agreed in writing, payment is due in full at the time of enrolment or booking.

We reserve the right to suspend or terminate access to services if payment is reversed, disputed, or fails.

6. Consumer Cancellation Rights

If you are purchasing as a consumer under UK law, you acknowledge that access to digital content may begin immediately upon purchase.

By completing your purchase, you expressly consent to immediate access and acknowledge that, to the extent permitted by law, this may result in loss of your statutory 14-day cancellation right once digital content access has commenced.

7. Refund Policy

Unless otherwise stated at the point of purchase, payments are non-refundable once services have commenced.

We may, at our discretion, offer a refund in exceptional circumstances. Nothing in these Terms affects statutory rights which cannot be excluded under applicable law.

8. Intellectual Property

All materials, content, frameworks, documents, recordings, and methodologies provided through our services remain our exclusive intellectual property.

You are granted a limited, personal, non-transferable licence to use materials for your own business purposes. You may not reproduce, distribute, resell, or share materials without prior written consent.

9. Digital Platform Access

Where services include access to a digital platform, access is personal and may not be shared unless agreed in writing.

You are responsible for safeguarding login credentials.

We may record sessions for quality, training, or educational purposes. Recordings remain our intellectual property.

We do not guarantee uninterrupted access to digital platforms and shall not be liable for temporary interruptions beyond our control.

10. Non-Solicitation

You agree not to solicit, hire, or engage any employee, contractor, affiliate, or participant introduced through our services during the engagement and for twelve (12) months following completion without prior written consent.

11. Chargebacks

You agree not to initiate a chargeback or payment dispute without first contacting us in writing to attempt resolution in good faith.

Initiating a chargeback without prior written notice may constitute a breach of these Terms.

12. Limitation of Liability

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot be excluded under applicable law.

Subject to the above, our total liability arising from any service shall not exceed the total amount paid by you for that service.

We shall not be liable for loss of profits, revenue, business opportunity, or any indirect or consequential losses.

13. Governing Law

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.

14. Severability

If any provision of these Terms is held unenforceable, the remainder shall remain in full force and effect.

15. Acceptance

By accessing our website or completing payment for any service, you confirm that you have read, understood, and agree to these Terms.
